The terms and conditions that govern your use of Realestory's real estate storytelling platform.

1. Acceptance of Terms

Welcome to Realestory. By accessing or using our platform, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Realestory, Inc. ("Realestory," "we," "us," or "our").

If you are using our Services on behalf of a real estate agency, brokerage, or other organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

Realestory is a real estate platform that enables:

  • Sellers: Create narrative-driven property listings that tell the unique story of their home, including memories, lifestyle features, and neighborhood character.
  • Buyers: Search for homes using conversational, lifestyle-based queries to find properties that match their desired living experience.
  • Agents: Assist clients with story creation, manage listings, and connect with potential buyers through our platform.

Our Services may include AI-powered features for narrative generation, search optimization, and property matching. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time.

3. User Accounts

3.1 Account Registration

To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Types

  • Seller Accounts: For property owners listing their homes for sale or rent.
  • Buyer Accounts: For individuals searching for properties to purchase or rent.
  • Agent Accounts: For licensed real estate professionals representing clients.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.

4. Seller Responsibilities

4.1 Accurate Property Information

Sellers must provide accurate and truthful information about their properties, including but not limited to:

  • Property address, square footage, and room counts
  • Property condition and known defects
  • Legal ownership and authority to sell or rent
  • HOA fees, property taxes, and other financial obligations
  • Any material facts that could affect a buyer's decision

4.2 Disclosure Requirements

Sellers must comply with all applicable federal, state, and local disclosure requirements. This includes disclosing known material defects, environmental hazards (such as lead paint, asbestos, or radon), flood zone status, and any other legally required information.

4.3 Story Content Guidelines

While we encourage sellers to share the unique story of their home, all narrative content must be:

  • Truthful and not misleading about the property's features or condition
  • Compliant with fair housing laws and free from discriminatory language
  • Respectful and appropriate for a general audience
  • Free from personally identifiable information about neighbors or previous occupants without consent

4.4 Media Content

Photos, videos, and other media must accurately represent the property. Significant alterations that misrepresent the property's appearance are prohibited. You must own or have rights to all media you upload.

5. Buyer Responsibilities

Buyers using our Services agree to:

  • Use the platform in good faith to search for properties
  • Respect property owner privacy and scheduled showing times
  • Conduct independent due diligence before making purchase decisions
  • Work with licensed professionals for transactions and inspections
  • Not use information obtained through the platform for any unlawful purpose

Important: Realestory does not verify the accuracy of property listings. Buyers should independently verify all property information before making any purchase decisions.

6. Agent Responsibilities

6.1 Licensing Requirements

Agents must maintain valid real estate licenses in all jurisdictions where they conduct business through our platform. You agree to provide proof of licensure upon request and to notify us immediately if your license is suspended or revoked.

6.2 Professional Conduct

Agents must adhere to all applicable real estate laws, regulations, and ethical standards, including those established by the National Association of Realtors® (if applicable) and state licensing boards.

6.3 Client Representation

When representing clients on the platform, agents must clearly disclose their role and any relationships that could affect their objectivity, including dual agency situations.

7. AI-Generated Content

Our platform may use artificial intelligence to assist with narrative generation, search optimization, and property matching. You acknowledge that:

  • AI-generated suggestions are tools to assist you, not replace professional judgment
  • You are responsible for reviewing and approving all AI-assisted content before publication
  • AI-generated content may require editing for accuracy and compliance
  • We do not guarantee the accuracy or completeness of AI-generated suggestions
  • AI search results are based on available data and may not include all matching properties

8. Intellectual Property

8.1 Platform Content

All content, features, and functionality of the Services (excluding User Content) are owned by Realestory and protected by copyright, trademark, and other intellectual property laws.

8.2 User Content License

By submitting content to the platform (including property stories, photos, and videos), you grant Realestory a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display such content in connection with the Services and for marketing purposes.

8.3 Content Ownership

You retain ownership of the original content you create, subject to the license granted above. You represent that you have all necessary rights to the content you submit.

9. Prohibited Activities

You agree not to:

  • Post false, misleading, or fraudulent property listings
  • Violate any fair housing laws or engage in discriminatory practices
  • Scrape, harvest, or collect data from the platform without authorization
  • Interfere with or disrupt the Services or servers
  • Impersonate another person or entity
  • Use the platform for any unlawful purpose, including real estate fraud
  • Circumvent any security measures or access restrictions
  • Post spam, solicitations, or unauthorized advertising
  • Harass, threaten, or harm other users

10. Transaction Disclaimer

Realestory is not a party to any real estate transaction. We provide a platform for connecting buyers and sellers but do not:

  • Act as a real estate broker, agent, or advisor
  • Verify the accuracy of property listings or user credentials
  • Guarantee the completion of any transaction
  • Handle escrow, title, or closing services
  • Provide legal, tax, or financial advice

All real estate transactions should be conducted with the assistance of licensed professionals including real estate agents, attorneys, inspectors, and lenders as appropriate.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALESTORY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from property transactions facilitated through the platform
  • Inaccurate or incomplete property information posted by users
  • Actions or omissions of other users, agents, or third parties
  • Any unauthorized access to or alteration of your content or data

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless Realestory and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your content or property listings
  • Any real estate transaction you engage in through the platform
  • Your violation of any laws or third-party rights

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to contact us at legal@realestory.com to attempt to resolve any dispute informally within 30 days.

13.2 Arbitration

Any dispute not resolved informally shall be resolved through binding arbitration conducted by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in San Francisco, California, or another mutually agreed location.

13.3 Class Action Waiver

You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action or other representative proceeding.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination:

  • Your license to use the Services immediately ends
  • We may remove your content from the platform
  • Active property listings will be deactivated
  • Provisions regarding intellectual property, limitation of liability, and dispute resolution survive termination

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the platform and updating the "Last Updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

16. General Provisions

  • Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Entire Agreement: These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Realestory.
  • Assignment: You may not assign these Terms without our written consent. We may assign our rights and obligations freely.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver.
